Agreement – Terms

Welcome to www.globalenergymaritime.com We’re happy you’re here, and we hope you enjoy everything we have to offer.

All access to any area on our platform at www.globalenergymaritime.com is governed by the terms of use below ("Terms").

Please continue only if you can accept these Terms. In these Terms, the words "GEM", "we", "us", "our" refers to Bulk Project Private Limited, owned and operate www.globalenergymaritime.com

Access to our platform:

The accessibility and operation of our website relies on technologies outside our control. We are not able to guarantee continuous accessibility or uninterrupted operation of our platform.

Advertising section: Recommended Section, Freight Routes, Sale & Purchase (SNP),
Main Banner, Sub-Categories Banner, Ad hoc Ads and Free listing.

• Pursuant to this Advertising Section, a business must be actively operating to be eligible for an advertising account on GEM’s online platform.
• You must be of legal age of 18 years old to advertise and to register.
• You may register for an Advertising account or Free listing account by filling the registration form and submitting the form on the online platform.

Advertising Account Responsibility:

• Successful registration, the user shall be responsible for maintaining the confidentiality and security of their login credentials.
• You must notify us in writing immediately if your passwords is disclosed.
• Login credentials should be kept secure. Any parties whom your user name or password is disclosed is authorised to act on your behalf of using our services and the online platform. You agree that you are solely responsible for maintaining the confidentiality of your login credentials.
• You agree that we may contact you using the contact details provided at registration.

Advertisement and Listing Authenticity:

• By posting an advertisement, you confirm that all information provided is accurate and genuine. Ads will remain visible for their intended duration.
• Advertisement deemed fake, false, misleading or unauthorised will be removed without notice.
• Duplicate listing of company’s profile is prohibited it will be removed upon detection, once an Advertisement is Lived, it is non-refundable.
• SNP, IMO number and ship’s name are shared for GEM’s vetting purpose; however, the buyer is still responsible for conducting their own independent due diligence, refer to the indemnity section of the clause for further details.
• Fake listings are strictly prohibited and will be dealt with immediately.

Sale & Purchase Advertisement:

• SNP Ads section please consult with us before listing the vessel (contact details on platform). Once an Advertisement is Lived, it is non-refundable.
• One advertisement is for one vessel, two or more vessels or units is prohibited.
• Advertiser’s responsibility to remove listings when a vessel is Sold, Chartered, in Closing or under MOA.
• Your advertisement must not include content that we deem, at our sole discretion, to be irrelevant to the intended audience or online platform.

Advertisement Post:

• All listing descriptions must provide an accurate representation of what is being advertised. Descriptions that may mislead buyers or the audience with false or inaccurate information or impressions are strictly prohibited.
• SNP is solely for sales, URLs are not allowed.
• URLs are permitted in the Recommended and Freight Routes.
• The primary language of all descriptions must be English. Descriptions in other languages are permitted as secondary language.
• Photos must show the actual vessel in its current condition, at the time of listing. No substitutions, outdated images, or shots of other vessels are allowed. Listings should visually match what buyers/surveyors will see in person.
• It is the sole responsibility of the advertiser to obtain copyrights or consent of use before using an artist impression from sources like website images and et cretera. GEM reserves the right to remove any image and material that breaches copyrights law.
• No displayed of freight rates allowed. 

Advertisement Photos Rejection:

• Photos are not of the advertised vessel and misleading. E.g.: Bulk Carrier and Oil Tanker, MPP vessel and Tug.
• Photos not of vessel content such as text or unrelated images.
• Photos not in the correct orientation -- side way or inverted.
• Duplicated photos.
• Photos contain other watermark website or logo.
• Photo made up of more than 1 image (collage).
• Blurry or Low resolution image.
• Vessel images must occupy at least 70% of the photo for clarity and focus.  
• Photos must not infringed copy-rights. 

Relying on information

We provide our online platform as a general information source only. We do not guarantee and make no warranty or representation regarding the accuracy, completeness, or reliability of the content.

Do note that we are not involved in giving professional advice here. The platform may not cover all information available on a particular issue. We would advise that you conduct your own due diligence checks or obtain professional advice relevant to your particular circumstances, outside of our online platform.

You agree that we will not be liable to you for any loss or damage of any kind arising in any way from or in connection with your use of our online platform or the content provided on our online platform, including content from our online platform which has been reproduced, used, published or made available by third-parties, and you agree that your use of such content is at your sole risk.

Security

Where appropriate, we use available technology to protect the security of communications made through our online platform. Do note that we do not accept liability for the security, authenticity, integrity or confidentiality of any transactions and other communications made through our online platform.

Internet communications may be susceptible to interference or interception by third parties. We will do our best but we cannot make any warranties that our online platform is free of infection by computer viruses or other unauthorised software.

Hyperlinks on and/or other Websites

You agree not to hold us liable for the availability or content of any other Internet site not provided by us, linked to or from our online platform.

The inclusion of hyperlinks to our online platform by third-party websites does not imply endorsement, sponsorship, or affiliation with any website.

Access to any other Internet site is at your own risk. If you create a link or frame to our online platform, you do so at your own risk.

We reserve the right to object or disable any link or frame to or from our online platform.

Restrictions on use of materials

All content on this online platform, including trade names, articles, texts, artwork, pictures, photographs, films, logo and related images, are protected by applicable laws, including intellectual property laws, and may not be reproduced or appropriated in any manner without the prior written consent of the relevant rights holder.

Third party content

Third party content may appear on the online platform or may be accessible via links from the online platform. We shall not be responsible and assumes no liability for any infringement, mistakes, misstatements of law, defamation, libel, slander, omissions, falsehood or profanity in the statements, opinions, representations or any other form of content contained in any third party content appearing on the platform.

Non-confidentiality

You agree that all information and/or particulars sent or submitted by you to us, in relation to the access of this online platform non-confidential and non-proprietary unless otherwise expressly indicated by you.

You further undertake not to submit any information and/or other materials which are or may be offensive, illegal or which may not be lawfully disseminated under the laws of Singapore or any other relevant country.

Modification to Terms of Use

The Terms of Use set out here may be edited from time to time. Updated versions of the Terms of Use will be posted on the web site and are effective immediately.

Privacy

Your use of the website is subject to our privacy policy.

Indemnity

You agree to indemnify us and hold us harmless, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from (i) your use or misuse of the Platform;(ii) your breach of these Terms; (iii) and/or your violation of any law or the rights of a third party, including the use by any other persons accessing the online platform using your internet account caused by your action or inaction.

Exclusion of Liability

We shall in no event be liable for any death, injury, direct, indirect, incidental, special, consequential, exemplary damages or other indirect damages or costs of any kind suffered or incurred by you arising from or in connection with:

Any access, use or the inability to access or use the online platform, or reliance on the content and/or any information in the Online Platform;

Any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus;

Any use of or access to any other website linked to the online Platform, even if we or our agents or employees are advised of the possibility of such damages, losses and/or expenses. Any hyperlinks to any other websites are not an endorsement of such websites and such websites should only be accessed at your own risks;

We are not obligated to monitor, control or endorse the content on the online Platform, and therefore specifically disclaims any liability arising from or in connection with your use of the online Platform. We also reserve the right to review materials posted, to edit, refuse to post, to remove any content, terminate your listing or paid Advertisements on the online Platform at our sole discretion at any time, without notice, for any reason whatsoever.

We disclaim all liability for any direct, incidental or consequential damage or loss suffered by you that may result from the collection, use or disclosure of your personal data, including but not limited to any loss of, or any inability to retrieve, any personal data, howsoever caused, or any inaccuracy in the personal data presented, used or transmitted.

This clause shall take effect according to Singapore law.
